This week Special Counsel Robert Mueller had a grand jury indict Roger Stone on charges that also incriminated Donald Trump. Then he had the FBI arrest Stone. Now Stone is facing criminal trial. This is how things are supposed to work, of course. But if you’ve been listening to some of the worst fear mongering over the past few months, you might have ended up seeing Stone’s arrest as a miracle.
For the past two months, we’ve been hearing about how Donald Trump’s appointment of corrupt Acting Attorney General Matthew Whitaker was going to prevent Robert Mueller from being able to indict or arrest any more people. But that clearly didn’t happen. For the past month we’ve been hearing about how Trump’s government shutdown was bringing a halt to grand juries and putting the FBI out of business. That clearly didn’t happen either. And of course we’ve been hearing from the start about how Trump was going to magically pardon his people before they could be arrested. That also didn’t happen.
There are a couple reasons for this. First, Donald Trump is focused on the wrong things, and he’s going about them in ways that don’t help his cause. He gained nothing by trying to sabotage the FBI in various manners that were never going to impact the Trump-Russia investigation. He also gained nothing by waiting until Mueller was nearly at the finish line before finally trying to make changes at the DOJ. And if he thought his shutdown was going to stop the investigation, he failed to realize that every government entity involved was going to prioritize its remaining resources to make sure Mueller could keep working.

This week’s criminal indictment and arrest of Roger Stone was about something far bigger than just Stone. The indictment omitted several of the alleged Stone crimes that Robert Mueller has been presenting to the grand jury, meaning that the case against Stone isn’t complete, and for now Mueller is simply looking to legally establish the criminal conspiracy that Stone participated in with WikiLeaks and the Donald Trump campaign.
Various political pundits were able to quickly figure out that Steve Bannon was the senior Trump campaign official who instructed Roger Stone to illegally conspire with WikiLeaks. But the indictment went further by specifying that Bannon himself was instructed to have Stone do this, and Palmer Report deduced that Bannon could only have taken this instruction from Donald Trump and/or a member of his family. It turns out a U.S. Senator agrees with us on this.
Democratic Senator Richard Blumenthal appeared on CNN and said this: “In my view, and probably in Robert Mueller’s view, that person, directing the senior official, had to be Donald Trump, or possibly Donald Trump Jr.” And if it was Junior, then he almost certainly ran it past his father first. Blumenthal then added that Donald Trump “is one step, maybe just a baby step, away from criminal charges.”

It’s been a key aspect of the Trump-Russia scandal that, despite being 100% verified, almost no one in the mainstream media has wanted to touch. Several top Republicans took large donations in 2016 from a Kremlin-connected oligarch named Len Blavatnik, and it was only technically legal because the oligarch happened to have dual U.S. citizenship. It’s always been the tip of the spear for the Kremlin’s control over the GOP in general. Now it looks like we’re about to finally get some answers – and it’s bad, bad news for Mitch McConnell.
Democratic Congresswoman Jackie Speier, a key member of the House Intelligence Committee who has also been newly named to the House Oversight Committee, appeared on MSNBC on Friday. She stated that she plans to use her newfound position in the House majority to investigate the recently exposed financial connection between Blavatnik and Donald Trump’s Treasury Secretary Steve Mnuchin. But it’s what she didn’t say that speaks loudest.
Back in May of 2017, Palmer Report cited disclosure documents which showed that Blavatnik had funneled $2.5 millionthrough a Super PAC to Mitch McConnell. Six months later, the Dallas Morning News reported the same thing. Since that time, no major media outlet has touched the story. Again, the money was legal. But if you’re a politician like McConnell and you make the conscious decision to take millions of barely legal dollars from a sketchy Kremlin oligarch, does anyone really believe you stop there? Or does the Russian money trail continue into criminal territory?
When Congresswoman Speier says she’s going to investigate the financial ties between Blavatnik and Mnuchin, that’s significant, but it’s just a starting point. The Blavatnik money trail leads back to Mitch McConnell, and everyone in politics knows as much. To target Blavatnik is to target McConnell – and we may finally get answers on why McConnell has been acting like some kind of Russian agent when it comes to protecting Kremlin asset Donald Trump.

On Saturday morning Donald Trump seemed intent on defending his recently arrested longtime friend Roger Stone. Trump tried to deflect from the seriousness of Stone’s crimes by falsely accusing his political rivals of committing similar crimes. But by Saturday evening, it was an entirely different story, and suddenly Trump decided to throw Stone all the way under the bus.
Here’s what Donald Trump tweeted about Roger Stone on Saturday night: “CBS reports that in the Roger Stone indictment, data was ‘released during the 2016 Election to damage Hillary Clinton.’ Oh really! What about the Fake and Unverified “Dossier,” a total phony conjob, that was paid for by Crooked Hillary to damage me and the Trump Campaign? What about all of the one sided Fake Media coverage (collusion with Crooked H?) that I had to endure during my very successful presidential campaign. What about the now revealed bias by Facebook and many others. Roger Stone didn’t even work for me anywhere near the Election!”
That last sentence, of course, is the one that matters. Sure, Trump is still trying to minimize Roger Stone’s crimes. But he’s also suddenly tryin to claim that Stone, his close friend and personal adviser of forty years, somehow played no meaningful role in the election. This is absurd, as by all accounts, Trump and Stone regularly spoke on the phone during the election and after Trump took office.

A Lawfare post from Friday—“Get Me Roger Stone”—well and thoroughly explained the most recent indictment from the Mueller team. The authors also defended the decision to arrest Stone rather than to issue to him a summons compelling his voluntary appearance in court:
The special counsel’s office made this [rationale] very clear in its motion to seal the indictment and related warrants and motions, filed the day before Stone’s arrest:True enough, but there continues to be much discussion about the propriety of arresting Stone. I have heard the tactics described as heavy-handed and rogue. This is nonsense. And I think there is a far stronger and more compelling justification for arresting Stone than the one articulated in Friday’s post.
Law enforcement believes that publicity resulting from disclosure of the Indictment and related materials on the public record prior to arrest will increase the risk of the defendant fleeing and destroying (or tampering with) evidence. It is therefore essential that any information concerning the pending indictment in this district be kept sealed prior to the defendant’s arrest.In such circumstances, the treatment of Stone is quite normal: arrests are often made by the FBI, and warrants are generally executed, in early-morning hours as a matter of standard operating procedures.
At least to my knowledge, Stone has no criminal record and is charged primarily with a white collar-ish sort of crime—lying to Congress. Those two factors might suggest that prosecutors forego an arrest and hand him a summons to turn himself in, as is typical in white-collar cases.
Stone was also charged with witness tampering, a crime that strikes at the heart of the judicial process. There are numerous allegations in the indictment of Stone urging others to lie. Those urgings clearly run afoul of the witness tampering statute. And, if that’s all there was to it, a summons might be the way to go.
But there is a more compelling reason to arrest him. The devil is in the details. Read, for instance, page 20 of the indictment, where prosecutors note that Stone emailed one witness and called him a “rat” and a “stoolie” and threatened to take that witness’s dog away from him. In another email that same day to that same witness, according to the indictment, Stone wrote “I am so ready. Let’s get it on. Prepare to die [expletive].”
Law enforcement simply does not hand a summons to someone who threatens to kill a witness and trust that person to act responsibly with it. No conscientious prosecutor would think a summons appropriate there, or think that a threat to kill a witness is simply what targets of grand jury investigations routinely do.
The witness tampering alleged here is more than just someone asking another, “pretty please,” to lie. Rather, it includes a death threat against a witness: “Prepare to die [expletive].”
Was Stone kidding? Maybe. Was it hyperbole? Perhaps. He can explain that after his arrest.
Arresting Stone was lawful, appropriate and fully justified by his own words and conduct.
