Trump Says He Is Not a Target in Investigations, but the Question Is Complicated - The New York Times
What are the implications for Mr. Trump if he is not a target of either investigation?
If Mr. Trump was told that he was neither subject nor target of those investigations, it essentially signaled at the time that he was safe from prosecution and that his conduct was not within the scope of a grand jury investigation.
But those designations can change at any time, and Mr. Trump did not say when Mr. Rosenstein last told his legal team that he was not a target.
There are also several reasons Mr. Trump might not be a target, said Joyce Vance, a former United States attorney in Alabama. The evidence might not be there to show that he crossed the line into activity defined as criminal by law. “He also might not be a target because there is a policy that you can’t indict a sitting president,” Ms. Vance said.

One of the prevailing challenges of reporting in the Trump era has been trying not to let the president dictate the terms of the news cycle. After nearly two years, it’s hard to say if anyone has yet figured out how to really cover Trump; it’s still the case that one tweet can derail the entire news cycle. It’s a reality-TV presidency, and we’re all tuned in for every twist and turn, not knowing what to expect in the next episode.

Attorneys from Special Counsel Robert Mueller’s office are the prosecutors locked in a mysterious grand jury subpoena fight that a state-owned foreign company has taken all the way to the Supreme Court, court records now confirm.
A docket unsealed by the U.S. District Court in Washington shows two prosecutors from Mueller’s office, Scott Meisler and Zainab Ahmad, are handling the dispute on behalf of the special counsel.

The country and the company resisting Mueller’s demand for information have still not been publicly identified, but the district court and a federal appeals court confirmed this week that Atlanta-based Alston and Bird is representing the firm at the center of the fight.
Alston and Bird’s clients have included Russian interests including a Russian oligarch, although it’s unclear if the present fight involves a company from Russia or elsewhere.
The dispute has proceeded with unusual secrecy, including — until now — the names of the lawyers for both sides being withheld by the three different federal courts to grapple with the matter.
However, with journalists pressing for more access to the details of the fight, the district court released a docket sheetWednesday laying out a timeline of the filings in the dispute. With no fanfare, the same court posted a slightly less redacted version of that docket online Thursday.
The new version revealed the names of Meisler and Ahmad, as well as four attorneys for the foreign company: Brian Boone, Ted Kang, Emily Costin and Karl Geercken.

On Friday, the D.C. Circuit Court of Appeals unsealed a document also naming Boone and Kang as lawyers for the company in that court. The Friday order making that document public also discloses that the opposition to unsealing the records has come from Mueller’s prosecutors, at least in recent weeks.
Meisler is an appellate lawyer who has worked on Mueller’s prosecution of former Trump campaign chairman Paul Manafort. Ahmad, who worked previously as a federal prosecutor in Brooklyn, is assigned to the case against former Trump national security adviser Michael Flynn.
Last month, the Reporters Committee for Freedom of the Press asked the Supreme Court and the D.C. Circuit to unseal more information about the legal imbroglio.
“It looks like it is the government that is resisting disclosure and that the company wanted the public to know that fact,” said Ted Boutrous, who is representing the Reporters Committee in its bid to unseal details of the case. “Absent some extraordinary order that we don’t know about, there is nothing stopping the company from revealing its identity and we are hoping it will do so now that its lawyers have gone on the record with their identity in this filing.”
Boone and Kang did not immediately reply to a request for comment Friday.
The government’s explanation of the need for some of the more extreme secrecy in the case, such as the deletion of prosecutors’ names and titles from the public record, has not been disclosed. However, in a Supreme Court filing last week, the Justice Department said it believed some more information in court filings there could be released without harming grand jury secrecy.
A spokesman for Mueller’s office declined to comment Friday, but acknowledged that Meisler and Ahmad are assigned to Mueller’s team.
POLITICO first reported last October that the court fight appeared to involve Mueller’s prosecutors. Shortly after a deadline on an appeal the firm was pursuing, a man entered the appeals court clerk’s office and said he needed a copy of the filing just submitted by the special counsel. The law firm representative refused to identify himself to a reporter who was present.
Another hint came from records showing D.C. Circuit Judge Greg Katsas — who formerly worked as deputy White House Counsel under President Donald Trump — recused himself from the dispute.
CNN has reported that it observed prosecutors from Mueller’s office emerging from Chief Judge Beryl Howell’s courtroom in September and October along with Kang and Boone. Kang’s page on the Alston and Bird website touts his involvement in Mueller-related matters.
“Representing numerous entities and individuals in connection with Special Counsel Robert Mueller’s investigation into Russian interference with the 2016 presidential election,” the page says.

So far, the firm has failed to get much traction for its arguments that the company should be immune from the grand jury demand because the firm is effectively part of a foreign government. Both Howell and a three-judge D.C. Circuit panel rejected those arguments.
When the firm took the issue to the Supreme Court, Chief Justice John Roberts briefly stayed Howell’s contempt order and the $50,000-a-day financial penalty Howell imposed for defying her order. However, the high court lifted that stay several weeks ago.
After that ruling, the two sides squared off again in front of Howell over whether she has power to enforce the financial sanction. She denied the firm’s motion to declare the order unenforceable, a docket made public this week shows.
While the Supreme Court turned down the company’s bid for emergency relief, the firm’s petition asking the justices to review the lower court rulings remains pending at the high court.

Yesterday, CNN posted a weird story claiming that, according to inside sources, the Senate Intel Committee had just received evidence showing that Donald Trump Jr wasn’t on the phone with his father just before the Trump Tower meeting with the Russians, but instead had two innocent phone calls with random business associates. Palmer Report quickly pointed out the numerous holes in the report. Then it started to fall apart. Now it’s fallen apart even further.
This story never should have been reported to begin with, considering that the reporters involved never saw the supposed evidence themselves, and based on the phrasing used in the CNN report, the “inside sources” appear to have merely been members of the Trump Organization. But then things got worse when the New York Times reported that the two supposed phone calls in question were to NASCAR boss Brian France and real estate developer Howard Lorber. We’re really supposed to believe that, on his way into a treason meeting with the Russians, Donald Trump Jr decided he needed to run it all past the guy from NASCAR? Now it’s gotten worse.
Howard Lorber isn’t just some real estate developer. Craig Unger of Vanity Fair has revealed that when Donald Trump first traveled to Russia more than twenty years ago to try to build Trump Tower Moscow, his old pal Lorber went with him. So if Donald Trump Jr was indeed chatting with Lorber on his way into his meeting with the Russians, it would mean Junior expected the meeting to be about Trump Tower Moscow before he even walked into the room – which would further incriminate him.
So if the Senate Intel Committee has indeed obtained phone records proving that Donald Trump Jr spoke with Howard Lorber on his way into this meeting, it’s really bad news for Junior. And if the records don’t really exist or are forged, then the Trump Organization just handed Junior the worst phony alibi of all time. In any case, Lorber and France are about to get subpoenaed if they haven’t been already. And there is still no reason to believe Trump Jr didn’t speak with his dad on the way into the meeting.

One week ago today, Roger Stone was arrested and charged with several felony counts, and his homes in Florida and New York were raided. That means the bar is set pretty high when it comes to what would qualify as Stone having an even worse day. But the events of today may end up being even worse for Stone, because it hits him in a way that he truly cares about.
Remember when Paul Manafort was facing two different federal judges? The one in the Eastern District of Virginia, T.S. Ellis, was a cranky guy who kept meddling in the case and frustrated everyone involved. The judge in Washington DC, Amy Berman Jackson, showed herself to be tough but fair, and not remotely interested in nonsense. As it turns out, Roger Stone had the bad luck to draw Berman Jackson for his case, and it’s already going poorly for him.
Roger Stone really, really, really wants to litigate his criminal case in the court of public opinion. It’s not that he necessarily expects to change any minds. It’s that he’s hoping to continue to rile up his fans and Donald Trump’s fans, so they’ll keep buying his political books, and donate to his legal defense fund. The more Stone paints himself as a victim, the more he’ll profit from the criminal charges against him. But the judge has no interest in letting him do this.
Judge Amy Berman Jackson told Roger Stone in court today that if he tries to inappropriately discuss the case against him in public, she’ll hit him with a gag order. This means Stone is headed to what he probably sees as the worst fate possible: irrelevance. The day of Stone’s arrest, we said he should enjoy his fifteen minutes while he could, because eventually, he was going to become as broken and faded from relevance as his old pal Paul Manafort. Now it sounds like Stone is headed there even sooner than expected.
