Ricardo Rosselló announced on Wednesday night that he renounces the governorship of Puerto Rico, effective Friday, August 2.

10:00 a.m. | Presidente de la Cámara de Representantes, Carlos "Johnny" Méndez dice que, al momento, no ha recibido informe de juristas que evalúan posibilidad de residenciamiento.

Las fuentes aseguraron que participaban de reuniones convocadas a última hora, para coordinar los pasos a seguir ante el panorama.
Sin embargo, Jay hizo claro que él no ha confirmado la información. 
Momentos antes, se confirmó en el mismo programa la salida del licenciado Elías Sánchez de la firma de asuntos públicos -con rama legal y de cabildeo- Wolf Popper LLC.
Se va Llerandi
La presión por la renuncia de Rosselló aumentó el martes con otra renuncia en su gabinete.
Ricardo Llerandi anunció su renuncia al cargo de secretario de la Gobernación de Puerto Rico en el marco de la crisis institucional por corrupción y por la difusión de un polémico chat.
Llerandi, en una carta dirigida a Rosselló, señala que renuncia también a los puestos de administrador de La Fortaleza -sede del Ejecutivo- y director de la Compañía de Comercio y Exportación, además de matizar que para hacer una transición más ordenada serán efectivas el 31 de julio.
La dimisión de Llerandi supone un episodio más en la desbandada de altos funcionarios del Ejecutivo de Rosselló, después de que se filtrara el contenido de un chat de 889 páginas en el que el gobernador y su círculo más cercano insultan y se mofan de la oposición, compañeros de partido, mujeres y miembros de la comunidad LGBT.
La lista de dimisiones tras el inicio de la crisis incluye al responsable de las Finanzas gubernamentales, Christian Sobrino; el asesor de comunicaciones, Carlos Bermúdez; el secretario de Estado, Luis Rivera Marín; el presidente del Banco de Desarrollo Económico, Gerardo Portela, y el ayudante especial de la primera dama, Raymond Cruz, entre otros.
En total, más de 50 altos cargos de la Administración han renunciado a sus cargos desde que Rosselló llegó al poder en enero de 2017.
"Estaré siempre agradecido por la confianza que me brindó para asumir estos cargos, así como las responsabilidades que en el camino me fueron encomendadas. Tuve la bendición de contar con un equipo extraordinario y los mejores años de mi vida profesional los tuve liderando la iniciativa PR Emprende", subraya Llerandi en la carta.
"Los últimos días han sido sumamente difíciles para todos. En esta coyuntura histórica me corresponde anteponer sobre cualquier consideración el bienestar de mi familia. Las amenazas recibidas las puedo tolerar como individuo, pero nunca permitiré que afecten a mi hogar. Mi esposa e hijos son todo para mí. Ese es mi deber principal", subraya.
La dimisión de Llerandi se suma a las anunciadas el martes por parte de uno de sus ayudantes, Raymond Cruz, y la de George Laws que dejará la dirección interina de la Administración de Asuntos Federales de Puerto Rico (Prfaa), a partir del 15 de agosto.

Possible DOJ Involvement in Puerto Rico’s Financial Meltdown

SAN JUAN/TEMECULA—The ongoing controversy over Puerto Rico’s insolvency and efforts to enlist congressional support for legal bankruptcy protection for the U.S. territory have resulted in fingers being pointed at the local Federal Bureau of Investigation (FBI). Puerto Rico U.S. Attorney’s office is also under fire for an alleged failure to investigate and prevent a reportedly massive fraud that may have contributed to the island’s financial crisis.
I am CEO of Commercial Solar Power, Inc., a company that was reportedly forced into bankruptcy by what has been described as the “bizarre behavior” of the Puerto Rico Electric Power Authority (PREPA), which has been used to redirect as much as $100 million a year from the people of Puerto Rico to select government officials.
On February 24, 2015, a private lawsuit was filed using the Racketeer Influenced and Corrupt Organizations Act (RICO), claiming government officials at PREPA stole over one billion dollars in public money over 10 years and committed one of the largest municipal bond frauds in United States history.
Increasing municipal bond defaults have been a growing concern among investors and politicians over the past few years. With the pending defaults on almost $70 billion dollars in municipal debt issued by various Puerto Rico municipalities, the Securities and Exchange Commission (SEC) has reportedly increased its efforts to monitor this sector.
As I understand from confidential sources, SEC audits have uncovered material irregularities relating to the issuance of unjustified credit ratings by Fitch Group, Inc., “a global leader in credit ratings and research,” according to its website. My confidential source has indicated that the initial probe will focus on bonds issued by Puerto Rico’s largest utility company PREPA.
However, Daniel Noonan, global head of communications at Fitch Group, stated in an email, “We have no knowledge of any of the investigations” alleged.
It has also been alleged that law enforcement authorities in Puerto Rico stood by and did nothing for a number of years—an assertion that was substantiated by a phone call originating in Alexandria, Virginia. Some months ago, I received a call from a man stating he worked for the U.S. government, inferring he was with the Central Intelligence Agency (CIA).
I was told that Puerto Rico came on his agency’s radar years ago because the head of the PREPA fuel purchase office started making direct calls to the then-president of Venezuela, Hugo Chavez. An agency listened in and found out that PREPA was buying sludge oil from Venezuela and billing the utility for high grade oil. The difference in value—hundreds of millions per year (today it would be $700 million a year and is said to be still going on)—was allegedly kicked back to the fuel office manager and distributed to politicians and government officials on the island.
As the unnamed government agency continued to listen in on the calls, the caller claimed it became clear that family members of Puerto Rican FBI agents and family members in the Puerto Rico U.S. Attorney’s office were receiving payments based on these “kickbacks.”
He went on to tell me that the Puerto Rico’s FBI office and U.S. Attorney will do nothing about the oil kickback scheme and the bond rating scheme because they were participating in it. He went on to suggest that because of the separation laws regarding CIA activities and U.S. national law enforcement, there was not much he could do.
On Monday, a senior source in a related U.S. government agency, speaking to Caribbean News Nowon condition of anonymity, confirmed almost word for word what I had apparently been told.
In the meantime, I received a voice message from someone said to be calling from the San Juan FBI office in response to complaints I made to members of Congress. He claimed the matter was being “looked at” to determine whether the circumstances cross the boundary from civil fraud to a criminal offense.
On June 24, 2015, the government of Puerto Rico issued a 23-page legislative report, no less than a detailed confession, which outlines how government officials in Puerto Rico conspired with Wall Street firms to commit $11 billion dollars in financial fraud.
After reviewing this document and other evidence for many months, I believe the FBI is claiming that the best prosecutors in the DOJ have not yet found criminal grounds to move forward.
According to the legislative report itself, PREPA paid previous bondholders with capital received from new investors, which is the classic hallmark of a Ponzi scheme.
“The above mentioned was done to benefit the financial community that issued the debt and who today is collecting same, without any monies having been invested in improvements to infrastructure, all to the detriment of the best interest of the people of Puerto Rico. We believe that the actions and circumstances mentioned above caused the economic insolvency which has plagued PREPA in the past years,” the report said.

The transaction was a “test run” with Venezuela’s state oil firm, Petroleos de Venezuela SA, or PDVSA, Edwin Rivera Serrano, head of the Electric Energy Authority, or AEE, said late Friday in a statement. Rivera didn’t say how much AEE paid for the oil, only saying it saved 1.5 percent in the deal. A call placed by The Associated Press on Saturday seeking further information from AEE went unanswered. PDVSA’s Citgo unit operates gasoline stations in Puerto Rico but the issue of AEE buying oil from Venezuelan President Hugo Chavez’s government caused a stir here when talks were announced in September. Some conservative politicians questioned if Puerto Rico should strike an oil deal with Venezuela, citing political tensions between the South American country and the United States. Tensions have run high recently between U.S. President George W. Bush and Chavez, a self-styled socialist who assails American-style capitalism and has branded Bush a “madman.” However, other Puerto Rican leaders saw it as an opportunity to buy oil under preferential terms from Venezuela — a deal the country has made with some Caribbean and South American nations. Despite the political tensions, the United States remains the top buyer of oil from Venezuela, the world’s No. 5 exporter. In early December Venezuela delivered discounted heating oil to a New York City low-income housing development, part of a promise Chavez made to provide oil directly to poor Americans. Chavez’s critics contend the oil deal is a cynical ploy to score public relations points and tweak the Bush administration. PIN/AP

SAN JUAN, Puerto Rico — Some 25 FBI agents this week raided municipal offices in San Juan, Puerto Rico, searching through documents and seizing digital records following an anonymous tip called into the comptroller’s office over how the mayor’s office awards government contracts – specifically, a $4.7 million deal with a construction company.
Since the FBI has for years ignored compelling evidence of a massive $11 billion financial fraud and a $1 billion fuel oil fraud scheme, both involving Puerto Rico Electric Power Authority (PREPA), and San Juan Mayor Carmen Yulin Cruz is constantly butting heads with President Donald Trump on social media, the appearance of politically motivated reprisal is inescapable.
Trump’s animosity towards Cruz was already on display last month when he said there would be no statehood for the US territory as long as critics such as the San Juans mayor remain in office.
In response, Cruz called Trump’s comments about statehood just another effort to avoid responsibility for his administration’s “negligence” in its widely criticized response to last year’s Hurricane Maria.
Governor Ricardo Rosselló added, “This is an insensitive, disrespectful comment to over three million Americans who live in the US territory of Puerto Rico.”
San Juan’s purchasing division was the target of the raid and, while FBI special agent Douglas Leff did not implicate Cruz in the raid, he told local media that “we are going to follow the investigation where it leads us”.
On Tuesday, Cruz tweeted that she has instructed city officials to cooperate with federal authorities and said, “If someone has done something wrong, they should undergo due process and face the consequences of their actions.”
Puerto Rican news agency El Nuevo Dia claimed that the construction company in question, BR Solutions, is owned by a businessman who has made questionable political donations to several Puerto Rican politicians.
Earlier this month, a US district court judge certified a class-action lawsuit against PREPA seeking compensation for an estimated $1 billion losses in electricity overcharges due to a fuel oil fraud by 20 co-conspirators including PREPA, Shell Oil, Petrobras, Alchem and various other laboratories and fuel oil suppliers.
In the original suit, filed on February 24, 2015, in the US District Court for the District of Puerto Rico, Puerto Rico residents and businesses accused PREPA and a total of 20 defendants of perpetuating an extensive fuel oil fraud, resulting in users of electricity in Puerto Rico being overcharged for electricity since 2002. The suit states the defendants colluded to deliver “dirty” fuel oil to PREPA while charging the higher prices for clean fuel oil – prices that were directly passed to users of electricity.
Attorneys allege that PREPA – one of the largest public power agencies in the United States – fraudulently agreed to accept millions of barrels of fuel oil that did not meet specifications of contracts between PREPA and its oil suppliers, or specifications set by the EPA.
PREPA accepted this non-compliant fuel oil and the laboratories certified the fuel oil as compliant due to a long-running corruption scheme that permeated the agency, according to the lawsuit.
In May 2016, a special commission established by the island’s Senate to look into allegations of fraud by PREPA turned over its findings to US federal authorities for further investigation.
In June 2015, another commission of the Puerto Rico House of Representatives issued a 23-page legislative report outlining how government officials in Puerto Rico conspired with Wall Street firms to commit $11 billion dollars in financial fraud.
According to the report, PREPA paid previous bondholders with capital received from new investors, which is the classic hallmark of a Ponzi scheme.
“Noteworthy is the fact that the aforementioned took place in the face of the credit houses, whom, knowing this, and therefore PRPA’s technical insolvency, allowed this public corporation, and thus the people of Puerto Rico, to continue running into debt,” the report said.
The commission recommended that the report be forwarded to the US Justice Department and the Securities Exchange Commission (SEC) for corresponding action.
Questions have since been raised as to the ongoing failure of the local FBI office and the US attorney in Puerto Rico to pursue any investigation into these allegations.

Notwithstanding that the 2015 legislative report, which Lawless described as “no less than a detailed confession”, clearly suggested that a criminal act had occurred and should be investigated, “After reviewing this document and other evidence for many months, the FBI is claiming that the best prosecutors in the DOJ have not yet found criminal grounds to move forward,” Lawless pointed out.
The report claimed that the financial intermediaries and the institutional bondholders, despite being fully aware of PREPA’s dire fiscal situation, had no qualms with unjustly enriching themselves and with having the consequences of their negligent acts be paid for by the people of Puerto Rico.
“Meanwhile, and fully aware that PREPA did not have the resources to repay the debt, investment firms, banks, credit houses, consulting engineers, and PREPA itself failed to bring out into public light the need to make adjustments to the rates charged by PREPA,” the report said.
Investors allowed PREPA to issue bonds, then, PREPA borrowed from private banks to pay the bond’s interests; then, borrowed from the Government Development Bank (GDB) to pay back the private bank loans, and the GDB, in turn, issued more bonds to refinance all. Afterwards, PREPA would issue a new debt to pay GDB’s outstanding interests, pay principal and pre-pay the new bonds’ interests for several years – a cycle that is repeated over and over – and in which the original debt is never paid, the report outlined.
“This practice could constitute a fraud scheme for which the federal agencies that regulate financial instruments and the Security Exchange Commission could take action against and/or pursue civil suits against these institutions,” the report said.
Meanwhile, thousands of displaced Puerto Ricans now living in Florida are the voting targets of candidates in crucial races for governor and US Senate as well as other state and federal offices ahead of the November midterm elections.
Orlando-area Democratic Rep. Darren Soto, of Florida’s 9th Congressional District, who is running for re-election, said one way they have helped educate displaced Puerto Rican voters is by discussing Donald Trump.
“We have had some help in defining the parties by saying that if you support Trump, you’re Republican, if you oppose Trump you’re a Democrat,” Soto said.

Un informe elaborado por un comité especial de abogados de Puerto Rico concluye que existen bases jurídicas para un juicio político contra el gobernador Ricardo Rosselló, con base en información de los medios locales.
Carlos Johnny Méndez, presidente de la Cámara de Representantes de Puerto Rico y quien comisionó el informe, señaló que en cuanto tengan el documento y de encontrar actos ilegales en los chats que pusieron a Rosselló en la mira comenzarían las diligencias para iniciar un juicio político contra el gobernante, quien se preveía anunciara este miércoles su renuncia.
“El informe está en el edificio del Capitolio, en cualquier momento lo tendremos en nuestras manos. Tan pronto como lo recibamos, si hay actos ilegales en los chats, comenzaremos el juicio político a menos que el gobernador renuncie de antemano”, dijo Méndez.
El Presidente de la Cámara de Representantes señaló el gobernador tiene hasta este miércoles para renunciar, pero de decidir no hacerlo, iniciarían el procedimiento en su contra. Aunque, agregó, en caso de que Rosselló dimita, Méndez presentará ante el Departamento de Justicia los hallazgos y recomendaciones del grupo de juristas.

En proceso ya iniciado

Con base en información de El Nuevo Día, Méndez habría informado al gobernador que se había iniciado el proceso en su contra.
“Se hizo en persona, mirándolo a los ojos, le hablé claramente (al gobernador). Le dije que el proceso de residenciamiento había comenzado y va a tener las consecuencias que tuviesen las recomendaciones de estos juristas”, expresó el líder cameral.

El mismo medio señala que el informe identificó cinco delitos, de los cuales cuatro son graves, tres violan el Código Penal y dos la Ley de Ética Gubernamental.
El informe concluye que Rosselló pudo haber incurrido en malversación de fondos públicos, además de haber sido negligente en el cumplimiento del deber y haber cometido aprovechamiento ilícito de trabajos o servicios públicos.

Aún en el puesto

Esta mañana, el secretario de Asuntos Públicos de Puerto Rico, Anthony Maceira, comunicó que Ricardo Rosselló no había presentado su dimisión, a pesar de las publicaciones en la prensa que indicaban que este miércoles abandonaría su puesto al frente del estado caribeño.
“El gobernador Ricardo Rosselló Nevares no ha renunciado y continúa en Puerto Rico. Como dijo ayer, está en un proceso de reflexión y de escuchar al pueblo”, aclaró el funcionario. A su vez, comentó que si se toma una decisión determinante, sería informada a la ciudadanía de forma regular.

¿Qué pasó?

Rosselló y otros miembros de su Gobierno están envueltos en un escándalo desde el 13 de julio, cuando se filtró un chat privado que contiene mensajes misóginos, homófobos y hasta bromas de mal gusto sobre el huracán María, que en 2017 arrasó con parte de Puerto Rico y dejó un saldo de casi 3.000 muertos. A partir de esa fecha, miles de personas se manifiestan en las calles para pedir la renuncia del político.
Sin embargo, el dirigente expresó que no piensa dejar su cargo antes de tiempo, mientras le queda un año y medio de mandato. Por otro lado, la Cámara de Representantes del Capitolio analiza si lleva a cabo un juicio político contra el mandatario para destituirlo. En caso de concretarse, sería la primera vez que un gobernador puertorriqueño es sometido a un proceso de “residenciamiento”.

Ricardo Rosselló announced on Wednesday night that he renounces the governorship of Puerto Rico, effective Friday, August 2.

Las fuentes aseguraron que participaban de reuniones convocadas a última hora, para coordinar los pasos a seguir ante el panorama.
Sin embargo, Jay hizo claro que él no ha confirmado la información. 
Momentos antes, se confirmó en el mismo programa la salida del licenciado Elías Sánchez de la firma de asuntos públicos -con rama legal y de cabildeo- Wolf Popper LLC.
Se va Llerandi
La presión por la renuncia de Rosselló aumentó el martes con otra renuncia en su gabinete.
Ricardo Llerandi anunció su renuncia al cargo de secretario de la Gobernación de Puerto Rico en el marco de la crisis institucional por corrupción y por la difusión de un polémico chat.
Llerandi, en una carta dirigida a Rosselló, señala que renuncia también a los puestos de administrador de La Fortaleza -sede del Ejecutivo- y director de la Compañía de Comercio y Exportación, además de matizar que para hacer una transición más ordenada serán efectivas el 31 de julio.
La dimisión de Llerandi supone un episodio más en la desbandada de altos funcionarios del Ejecutivo de Rosselló, después de que se filtrara el contenido de un chat de 889 páginas en el que el gobernador y su círculo más cercano insultan y se mofan de la oposición, compañeros de partido, mujeres y miembros de la comunidad LGBT.
La lista de dimisiones tras el inicio de la crisis incluye al responsable de las Finanzas gubernamentales, Christian Sobrino; el asesor de comunicaciones, Carlos Bermúdez; el secretario de Estado, Luis Rivera Marín; el presidente del Banco de Desarrollo Económico, Gerardo Portela, y el ayudante especial de la primera dama, Raymond Cruz, entre otros.
En total, más de 50 altos cargos de la Administración han renunciado a sus cargos desde que Rosselló llegó al poder en enero de 2017.
"Estaré siempre agradecido por la confianza que me brindó para asumir estos cargos, así como las responsabilidades que en el camino me fueron encomendadas. Tuve la bendición de contar con un equipo extraordinario y los mejores años de mi vida profesional los tuve liderando la iniciativa PR Emprende", subraya Llerandi en la carta.
"Los últimos días han sido sumamente difíciles para todos. En esta coyuntura histórica me corresponde anteponer sobre cualquier consideración el bienestar de mi familia. Las amenazas recibidas las puedo tolerar como individuo, pero nunca permitiré que afecten a mi hogar. Mi esposa e hijos son todo para mí. Ese es mi deber principal", subraya.
La dimisión de Llerandi se suma a las anunciadas el martes por parte de uno de sus ayudantes, Raymond Cruz, y la de George Laws que dejará la dirección interina de la Administración de Asuntos Federales de Puerto Rico (Prfaa), a partir del 15 de agosto.

Possible DOJ Involvement in Puerto Rico’s Financial Meltdown

SAN JUAN/TEMECULA—The ongoing controversy over Puerto Rico’s insolvency and efforts to enlist congressional support for legal bankruptcy protection for the U.S. territory have resulted in fingers being pointed at the local Federal Bureau of Investigation (FBI). Puerto Rico U.S. Attorney’s office is also under fire for an alleged failure to investigate and prevent a reportedly massive fraud that may have contributed to the island’s financial crisis.
I am CEO of Commercial Solar Power, Inc., a company that was reportedly forced into bankruptcy by what has been described as the “bizarre behavior” of the Puerto Rico Electric Power Authority (PREPA), which has been used to redirect as much as $100 million a year from the people of Puerto Rico to select government officials.
On February 24, 2015, a private lawsuit was filed using the Racketeer Influenced and Corrupt Organizations Act (RICO), claiming government officials at PREPA stole over one billion dollars in public money over 10 years and committed one of the largest municipal bond frauds in United States history.
Increasing municipal bond defaults have been a growing concern among investors and politicians over the past few years. With the pending defaults on almost $70 billion dollars in municipal debt issued by various Puerto Rico municipalities, the Securities and Exchange Commission (SEC) has reportedly increased its efforts to monitor this sector.
As I understand from confidential sources, SEC audits have uncovered material irregularities relating to the issuance of unjustified credit ratings by Fitch Group, Inc., “a global leader in credit ratings and research,” according to its website. My confidential source has indicated that the initial probe will focus on bonds issued by Puerto Rico’s largest utility company PREPA.
However, Daniel Noonan, global head of communications at Fitch Group, stated in an email, “We have no knowledge of any of the investigations” alleged.
It has also been alleged that law enforcement authorities in Puerto Rico stood by and did nothing for a number of years—an assertion that was substantiated by a phone call originating in Alexandria, Virginia. Some months ago, I received a call from a man stating he worked for the U.S. government, inferring he was with the Central Intelligence Agency (CIA).
I was told that Puerto Rico came on his agency’s radar years ago because the head of the PREPA fuel purchase office started making direct calls to the then-president of Venezuela, Hugo Chavez. An agency listened in and found out that PREPA was buying sludge oil from Venezuela and billing the utility for high grade oil. The difference in value—hundreds of millions per year (today it would be $700 million a year and is said to be still going on)—was allegedly kicked back to the fuel office manager and distributed to politicians and government officials on the island.
As the unnamed government agency continued to listen in on the calls, the caller claimed it became clear that family members of Puerto Rican FBI agents and family members in the Puerto Rico U.S. Attorney’s office were receiving payments based on these “kickbacks.”
He went on to tell me that the Puerto Rico’s FBI office and U.S. Attorney will do nothing about the oil kickback scheme and the bond rating scheme because they were participating in it. He went on to suggest that because of the separation laws regarding CIA activities and U.S. national law enforcement, there was not much he could do.
On Monday, a senior source in a related U.S. government agency, speaking to Caribbean News Nowon condition of anonymity, confirmed almost word for word what I had apparently been told.
In the meantime, I received a voice message from someone said to be calling from the San Juan FBI office in response to complaints I made to members of Congress. He claimed the matter was being “looked at” to determine whether the circumstances cross the boundary from civil fraud to a criminal offense.
On June 24, 2015, the government of Puerto Rico issued a 23-page legislative report, no less than a detailed confession, which outlines how government officials in Puerto Rico conspired with Wall Street firms to commit $11 billion dollars in financial fraud.
After reviewing this document and other evidence for many months, I believe the FBI is claiming that the best prosecutors in the DOJ have not yet found criminal grounds to move forward.
According to the legislative report itself, PREPA paid previous bondholders with capital received from new investors, which is the classic hallmark of a Ponzi scheme.
“The above mentioned was done to benefit the financial community that issued the debt and who today is collecting same, without any monies having been invested in improvements to infrastructure, all to the detriment of the best interest of the people of Puerto Rico. We believe that the actions and circumstances mentioned above caused the economic insolvency which has plagued PREPA in the past years,” the report said.

The transaction was a “test run” with Venezuela’s state oil firm, Petroleos de Venezuela SA, or PDVSA, Edwin Rivera Serrano, head of the Electric Energy Authority, or AEE, said late Friday in a statement. Rivera didn’t say how much AEE paid for the oil, only saying it saved 1.5 percent in the deal. A call placed by The Associated Press on Saturday seeking further information from AEE went unanswered. PDVSA’s Citgo unit operates gasoline stations in Puerto Rico but the issue of AEE buying oil from Venezuelan President Hugo Chavez’s government caused a stir here when talks were announced in September. Some conservative politicians questioned if Puerto Rico should strike an oil deal with Venezuela, citing political tensions between the South American country and the United States. Tensions have run high recently between U.S. President George W. Bush and Chavez, a self-styled socialist who assails American-style capitalism and has branded Bush a “madman.” However, other Puerto Rican leaders saw it as an opportunity to buy oil under preferential terms from Venezuela — a deal the country has made with some Caribbean and South American nations. Despite the political tensions, the United States remains the top buyer of oil from Venezuela, the world’s No. 5 exporter. In early December Venezuela delivered discounted heating oil to a New York City low-income housing development, part of a promise Chavez made to provide oil directly to poor Americans. SAN JUAN, Puerto Rico — Some 25 FBI agents this week raided municipal offices in San Juan, Puerto Rico, searching through documents and seizing digital records following an anonymous tip called into the comptroller’s office over how the mayor’s office awards government contracts – specifically, a $4.7 million deal with a construction company.
Since the FBI has for years ignored compelling evidence of a massive $11 billion financial fraud and a $1 billion fuel oil fraud scheme, both involving Puerto Rico Electric Power Authority (PREPA), and San Juan Mayor Carmen Yulin Cruz is constantly butting heads with President Donald Trump on social media, the appearance of politically motivated reprisal is inescapable.
Trump’s animosity towards Cruz was already on display last month when he said there would be no statehood for the US territory as long as critics such as the San Juans mayor remain in office.
In response, Cruz called Trump’s comments about statehood just another effort to avoid responsibility for his administration’s “negligence” in its widely criticized response to last year’s Hurricane Maria.
Governor Ricardo Rosselló added, “This is an insensitive, disrespectful comment to over three million Americans who live in the US territory of Puerto Rico.”
San Juan’s purchasing division was the target of the raid and, while FBI special agent Douglas Leff did not implicate Cruz in the raid, he told local media that “we are going to follow the investigation where it leads us”.
On Tuesday, Cruz tweeted that she has instructed city officials to cooperate with federal authorities and said, “If someone has done something wrong, they should undergo due process and face the consequences of their actions.”
Puerto Rican news agency El Nuevo Dia claimed that the construction company in question, BR Solutions, is owned by a businessman who has made questionable political donations to several Puerto Rican politicians.
Earlier this month, a US district court judge certified a class-action lawsuit against PREPA seeking compensation for an estimated $1 billion losses in electricity overcharges due to a fuel oil fraud by 20 co-conspirators including PREPA, Shell Oil, Petrobras, Alchem and various other laboratories and fuel oil suppliers.
In the original suit, filed on February 24, 2015, in the US District Court for the District of Puerto Rico, Puerto Rico residents and businesses accused PREPA and a total of 20 defendants of perpetuating an extensive fuel oil fraud, resulting in users of electricity in Puerto Rico being overcharged for electricity since 2002. The suit states the defendants colluded to deliver “dirty” fuel oil to PREPA while charging the higher prices for clean fuel oil – prices that were directly passed to users of electricity.
Attorneys allege that PREPA – one of the largest public power agencies in the United States – fraudulently agreed to accept millions of barrels of fuel oil that did not meet specifications of contracts between PREPA and its oil suppliers, or specifications set by the EPA.
PREPA accepted this non-compliant fuel oil and the laboratories certified the fuel oil as compliant due to a long-running corruption scheme that permeated the agency, according to the lawsuit.
In May 2016, a special commission established by the island’s Senate to look into allegations of fraud by PREPA turned over its findings to US federal authorities for further investigation.
In June 2015, another commission of the Puerto Rico House of Representatives issued a 23-page legislative report outlining how government officials in Puerto Rico conspired with Wall Street firms to commit $11 billion dollars in financial fraud.
According to the report, PREPA paid previous bondholders with capital received from new investors, which is the classic hallmark of a Ponzi scheme.
“Noteworthy is the fact that the aforementioned took place in the face of the credit houses, whom, knowing this, and therefore PRPA’s technical insolvency, allowed this public corporation, and thus the people of Puerto Rico, to continue running into debt,” the report said.
The commission recommended that the report be forwarded to the US Justice Department and the Securities Exchange Commission (SEC) for corresponding action.
Questions have since been raised as to the ongoing failure of the local FBI office and the US attorney in Puerto Rico to pursue any investigation into these allegations.

Notwithstanding that the 2015 legislative report, which Lawless described as “no less than a detailed confession”, clearly suggested that a criminal act had occurred and should be investigated, “After reviewing this document and other evidence for many months, the FBI is claiming that the best prosecutors in the DOJ have not yet found criminal grounds to move forward,” Lawless pointed out.
The report claimed that the financial intermediaries and the institutional bondholders, despite being fully aware of PREPA’s dire fiscal situation, had no qualms with unjustly enriching themselves and with having the consequences of their negligent acts be paid for by the people of Puerto Rico.
“Meanwhile, and fully aware that PREPA did not have the resources to repay the debt, investment firms, banks, credit houses, consulting engineers, and PREPA itself failed to bring out into public light the need to make adjustments to the rates charged by PREPA,” the report said.
Investors allowed PREPA to issue bonds, then, PREPA borrowed from private banks to pay the bond’s interests; then, borrowed from the Government Development Bank (GDB) to pay back the private bank loans, and the GDB, in turn, issued more bonds to refinance all. Afterwards, PREPA would issue a new debt to pay GDB’s outstanding interests, pay principal and pre-pay the new bonds’ interests for several years – a cycle that is repeated over and over – and in which the original debt is never paid, the report outlined.
“This practice could constitute a fraud scheme for which the federal agencies that regulate financial instruments and the Security Exchange Commission could take action against and/or pursue civil suits against these institutions,” the report said.
Meanwhile, thousands of displaced Puerto Ricans now living in Florida are the voting targets of candidates in crucial races for governor and US Senate as well as other state and federal offices ahead of the November midterm elections.
Orlando-area Democratic Rep. Darren Soto, of Florida’s 9th Congressional District, who is running for re-election, said one way they have helped educate displaced Puerto Rican voters is by discussing Donald Trump.
“We have had some help in defining the parties by saying that if you support Trump, you’re Republican, if you oppose Trump you’re a Democrat,” Soto said.
