Comey issued a fresh and tightly limited subpoena on October 28. Anything other than possibly mishandled classified government emails was strictly off limits. “Law enforcement personnel will make reasonable efforts to restrict their search to data falling within the categories of evidence specified in the warrant.”
As for the mutinous NYPD officers who were itching to slap on some cuffs, “they’ve gotten huge pushback, to the point of coercion, from the Justice Department.”

But the FBI concluded that there was nothing in those emails that warranted indicting Clinton. The FBI's inspector general, who acts as the bureau's internal watchdog, has been conducting a probe into the handling of both the Clinton email investigation as well as the Trump-Russia probe.The IG is examining why it took McCabe weeks to sift through the thousands of emails found on Weiner's laptop. The FBI has historically been wary of undertaking matters that could be perceived as tilting an election.Clinton, in her post-election book tour, has listed the FBI as one of the top reasons she believes she lost, for having announced it was essentially reopening its probe only to later say it had found nothing to change its conclusions. The IG, Michael E. Horowitz, is exploring why the FBI's leadership appeared unwilling to explore the emails found on Weiner's machine, according to the Post. The new Trump-appointed FBI Director, Christopher Wray, alluded to the IG report in a letter to staff sent Monday. 'It would be inappropriate for me to comment on specific aspects of the IG's review right now,' Wray said in the message, NBC reported. 'But I can assure you that I remain staunchly committed to doing this job, in every respect, 'by the book.' I will not be swayed by political or other pressure in my decision making.'

The Justice Department on Friday turned over to Congress nearly 400 pages of text messages sent between Strzok and Page.Strzok, who was the FBI's deputy director of counter-intelligence, was removed from Special Counsel Robert Mueller's team after an internal investigation revealed that he had sent anti-Trump messages. Mueller is heading the investigation into alleged Russian meddling in the 2016 presidential election. Page left the team before the texts became public. According to Fox News, one exchange between Page and Strzok suggests that they knew Clinton would not be charged in an FBI probe of her using a private email server. In the messages, sent July 1, 2016, Page and Strzok discussed then-Attorney General Loretta Lynch's decision to accept the FBI's conclusion in the Clinton investigation. ‘Timing looks like hell,’ Strzok said. ‘Yeah, that is awful timing,’ Page responded, adding in another message: ‘It’s a real profile in courag(e), since she knows no charges will be brought'. Just a few days after those messages were sent, Comey announced that no charges would be brought against Clinton even though he referred to the Democratic presidential candidate's use of the private email server as 'extremely careless'. Anthony Weiner is behind bars in Massachusetts, serving 21 months after pleading guilty to federal obscenity charges for sexting with a teenage girl. Weiner’s silver Dell laptop, however, refuses to go away.
In October 2016, the discovery that e-mails from Hillary Clinton to Huma Abedin—her chief aide and Weiner’s wife—had been copied to Weiner’s laptop led to then-F.B.I. director James Comey announcing that he was reopening the bureau’s investigation of Clinton’s messaging habits. The new probe found nothing new or incriminating—but its launching may have swung a decisive number of votes to Donald Trump. After the election, the laptop became central to a theory that anti-Clinton agents in the bureau’s New York office withheld its contents in order to force Comey’s hand. Now the laptop intrigue is back with a vengeance, and this time, it is being used to suggest that the F.B.I.’s leadership was somehow biased in favor of Clinton—and to help justify the ouster of F.B.I. Deputy Director Andrew McCabe. On Monday, leaks claimed that a forthcoming report by U.S. Inspector General Michael Horowitz will paint an unflattering picture of McCabe’s decisions. On Tuesday, The Washington Post sketched in some additional detail, basically inferring that McCabe dragged his feet on reviewing the Weiner laptop e-mails at the height of the 2016 presidential campaign. But Michael Steinbach, the F.B.I.’s former executive assistant director for national security, who worked on the investigation, dismisses both the pro- and anti-Clinton laptop conspiracy theories. Rather, he says the roughly three weeks that elapsed between the seizing of Weiner’s laptop and Comey’s decision to reopen the investigation were consumed by ordinary law-enforcement bureaucracy. “The Weiner investigation was opened up based on Weiner’s inappropriate contacts,” Steinbach says. “In the course of that investigation, New York got a warrant and searched the laptop. As soon as they identified some evidence, the head of the New York office, Bill Sweeney, called down and spoke to the deputy director and a few others. I wasn’t at that meeting, but he called me later that day and said, ‘Hey, we’ve got something.’” After the unexpected discovery of e-mails from Clinton’s State Department domain name on Weiner’s laptop, Justice Department investigators discussed whether a second search warrant was needed to review them. “At the time, we got the initial information, it was 600,000 bits or streams of information. There was no belief we would be able to review that quantity of information inside of two months, three months,” Steinbach says. “The conspiracy theory may sound good, but in reality, when you know the volume of what we thought we had—which turned out to be wrong—and the likelihood we would find new e-mails that were classified, which would then need to be kicked out to N.S.A. or C.I.A., for the classification review, we thought this would be probably a couple months-long process.” McCabe was also contending with the then-undisclosed F.B.I. probe into possible contacts between the Trump campaign and Russian operatives, plus a possible inquiry into Clinton Foundation donations. His life became even more complicated on October 24, 2016, when The Wall Street Journal ran a story reporting that the political action committee of Virginia Governor Terry McAuliffe, a longtime Clinton ally, had contributed nearly $500,000 to the state Senate campaign of McCabe’s wife. On October 27, in a 5 a.m. email, McCabe told Comey they needed to meet as soon as possible. Later that morning, he explained that Clinton e-mails had been found on Weiner’s laptop. The next day, Comey notified Congress that he was reopening the investigation. On October 30, the F.B.I. obtained the second search warrant, allowing it to look at the Clinton e-mails on Weiner’s laptop. “That three weeks, people have complained it took too long. Maybe it did,” Steinbach says. “But it wasn’t conspiracy. It was more about, ‘What do we have? How do we do this? What legal process do we do it with?’” On November 1, McCabe voluntary recused himself from the Clinton investigation. Trump has repeatedly attacked him as biased, because of McCabe’s wife’s run as a Democratic candidate. So far, there is no evidence that’s true. But even if the inspector general finds that McCabe’s motivations were pure, and the F.B.I. was slow to act on Weiner’s laptop out of nothing more than diligent standard procedure or of a failure to recognize its possible importance, Trump’s allies will no doubt add a malign spin. “The most significant thing that the F.B.I. did that was problematic was to parachute into the election with 11 days left and announce a phony criminal investigation into Hillary Clinton, thereby dooming her candidacy. Yet somehow we’ve managed to be engulfed in this charade that Donald Trump is the persecuted victim,” says Congressman Hakeem Jeffries, a New York Democrat. “This is classic Trump, where up is down and left is right and the sun is the moon. It’s amazing to me. I have to give them credit. What are we on our side doing wrong?”
